By accessing or using the Royalsome website, mobile application, or any other services provided by Royalsome (collectively, the "Services"), you agree to be bound by these Terms of Service. "Game Development Services" refers to the mobile game development services provided by Royalsome to clients.

3. Service Description

Royalsome provides mobile game development services, including but not limited to game concept development, game design, development, testing, launch strategy, and post-launch support. Our Services are designed to assist clients in creating and launching successful mobile games in the Australian market and globally.

4. Account Registration

4.1 Account Creation

To access certain features of our Services, you may need to create an account. When registering for an account, you agree to provide accurate, current, and complete information about yourself. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4.2 Account Security

You are solely responsible for maintaining the security of your account and password. Royalsome cannot and will not be liable for any loss or damage resulting from your failure to comply with security precautions. You agree to notify Royalsome immediately of any unauthorized use of your account or any other breach of security.

5. User Conduct

You agree not to use the Services to:

Violate any applicable laws, regulations, or third-party rights
Upload, transmit, or distribute any content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
Impersonate any person or entity or falsely state or otherwise misrepresent your affiliation with a person or entity
Interfere with or disrupt the Services or servers or networks connected to the Services
Attempt to gain unauthorized access to any portion of the Services or any other accounts, computer systems, or networks connected to the Services
Use any robot, spider, scraper, or other automated means to access the Services for any purpose
Harvest or collect email addresses or other contact information of other users from the Services

6. Intellectual Property Rights

6.1 Royalsome's Intellectual Property

All content, features, and functionality of the Services, including but not limited to text, graphics, logos, button icons, images, audio clips, data compilations, and software, are the exclusive property of Royalsome or its licensors and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

6.2 Client Intellectual Property

For game development projects, the ownership of intellectual property rights will be governed by the specific agreement between Royalsome and the client. Unless otherwise specified in a written agreement, clients retain ownership of original content they provide to Royalsome, while Royalsome retains ownership of pre-existing tools, frameworks, and methodologies used in the development process.

7. Payment Terms

7.1 Fees and Billing

Pricing for our Game Development Services is as specified on our website or as outlined in a separate agreement with you. Royalsome reserves the right to change its fees and billing methods at any time, with notice provided to users through the website or email.

7.2 Payment Processing

Payments are processed through secure third-party payment processors. By making a payment, you agree to comply with the terms and conditions of these payment processors in addition to these Terms.

8. Termination

Royalsome reserves the right to suspend or terminate your access to the Services at any time, with or without cause and with or without notice. Upon termination, your right to use the Services will immediately cease, but all provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

9. Disclaimers and Limitations of Liability

9.1 Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. ROYALSOME DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICES OR THE SERVERS THAT MAKE THEM AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

9.2 Limitation of Liability

IN NO EVENT SHALL ROYALSOME, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS, BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES WHATSOEVER RESULTING FROM ANY (I) ERRORS, MISTAKES, OR INACCURACIES OF CONTENT, (II) PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO AND USE OF OUR SERVICES, (III) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SECURE SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION AND/OR FINANCIAL INFORMATION STORED THEREIN, (IV) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM OUR SERVICES, (V) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE, WHICH MAY BE TRANSMITTED TO OR THROUGH OUR SERVICES BY ANY THIRD PARTY, AND/OR (VI) ANY ERRORS OR OMISSIONS IN ANY CONTENT OR FOR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF YOUR USE OF ANY CONTENT POSTED, EMAILED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT THE COMPANY IS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

10. Indemnification

You agree to defend, indemnify, and hold harmless Royalsome, its officers, directors, employees, and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from: (i) your use of and access to the Services; (ii) your violation of any term of these Terms; (iii) your violation of any third-party right, including without limitation any copyright, property, or privacy right; or (iv) any claim that your content caused damage to a third party.

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Australia, without regard to its conflict of law principles. Any dispute arising from or relating to these Terms or your use of the Services shall be exclusively submitted to the courts of Victoria, Australia.

12. Changes to Terms

Royalsome reserves the right to modify these Terms at any time. We will provide notice of significant changes to these Terms by posting the new Terms on our website and/or sending you an email. Your continued use of the Services after such modifications will constitute your acknowledgment and agreement to the modified Terms.
